Terms of Service

By enrolling in and/or attending a course, you agree to be bound by these Terms of Service:

Introduction and Acceptance of Agreement

 

  • While participating in any TINY Studios activities, you agree to be bound by the clauses outlined in these Terms of Service.

  • By agreeing to these Terms of Service, you agree you are over the age of 18. If you are under 18, you must have a guardian accept these Terms of Service on your behalf.

  • You agree that your enrolment is only final once TINY Studios has received your acceptance of these Terms of Service, as well as payment, in accordance with the Payment Terms outlined in this document.

  • TINY Studios reserves the right to refuse any enrolment as permitted by law.

  • TINY Studios may amend, remove or update any clause/s within this Terms of Service, at their discretion. All terms laid out within this document can be discussed in person with TINY Studios, who will ultimately make the final decision.

  • “Physical Theatre Studio” may also be referred to as the “Year-long Program”

 

Limitation of Liability or Disclaimers
 

  • TINY Studios will exercise reasonable care in the course of any activity. There is, nonetheless, an inherent risk of harm involved in any activity. Other people participating in TINY Studios activities may take part in a dangerous, reckless or negligent manner, or with a lack of skill. By submitting your enrolment, you agree to

    • bear all risks of any injuries, damages or harm which may arise during or resulting from your participation in TINY Studios activities (These risks include, but are not limited to, the possibility of accident or illness while travelling to and from the activity as well as any injury arising out of participation in the activity itself).

    • waive all claims against TINY Studios and its employees for any injuries, damages, losses liabilities, expenses, demands or claims, which may arise during or resulting from your participation in TINY Studios activities.

    • indemnify and hold TINY Studios and its employees, from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable legal fees and other litigation costs and expenses) incurred as part of any claims resulting from your participation in TINY Studios activities.

 

Privacy Policy

 

  • We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

 

  • A copy of the Australian Privacy Principles may be obtained from the website of The Office of the Australian Information Commissioner at www.aoic.gov.au

Personal Information

 

  • Personal Information is information or an opinion that identifies an individual. Examples of Personal Information TINY Studios may collect include: names, addresses, email addresses and telephone numbers.
     

  • Any Personal Information collected by TINY Studios will be used for the primary purpose of providing our services to you and for marketing.
     

  • TINY Studios may obtain this Personal Information in various ways, including, but not limited to: interviews, correspondence, telephone, email, via our website or social media, from your website, from media and publications, from other publicly available sources and from third parties. We don’t guarantee website links or policy of authorised third parties.

 

  • We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure.
     

  • When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.
     

Sensitive Information

 

  • Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

 

  • Sensitive information will be used by us only:

    • For the primary purpose for which it was obtained

    • For a secondary purpose that is directly related to the primary purpose

    • With your consent; or where required or authorised by law.

Third Parties

 

  • Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties (such as an online payment platform). In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.
     

Disclosure of Personal Information

 

  • Your Personal Information may be disclosed in a number of circumstances including the following:

    • Third parties where you consent to the use or disclosure; and

    • Where required or authorised by law.
       

Security of Personal Information

 

  • Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.
     

  • When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 5 years.
     

Access to your Personal Information

 

  • You may access the Personal Information we hold about you to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.
     

  • In order to protect your Personal Information, we may require identification from you before releasing the requested information.
     

Maintaining the Quality of your Personal Information

 

  • It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

 

Intellectual Property Rights
 

  • Participants may not publish, distribute or upload recordings (audio, videos or photos) of any activities undertake with TINY Studios without prior approval from TINY Studios. This will not reasonably be withheld.

  • Content developed through direct participation in TINY Studios activities will remain the Intellectual Property of TINY Studios, as per current Intellectual Property Laws in Australia.

  • Participants will not distribute TINY Studios content, methodologies, practices and other forms of Intellectual Property. If so, they will be bound by the current Intellectual Property Laws of Australia and legal action may be sought.

  • Should you intend to use any IP from a TINY Studios activity for your own artistic practice outside the activity, express permission must be sought first and a separate agreement regarding fair use must be created and agreed upon by both parties. This won’t be unreasonably withheld.

Photo / Media Consent
 

  • TINY Studios may use different forms of technology to take photographs, videos and/or images of students work. These are used for documentation, promotion (inclusive of social media) and for other general use. By agreeing to these Terms of Service, you agree to the general use of your image/s.

  • TINY Studios will make reasonable effort to obtain individual photo/media consent should an image want to be used for commercial or non-general purposes.

  • If you do not want to give permission to any photo/media use, please inform TINY Studios in writing by email.

 

Medical Treatment Consent
 

  • Should TINY Studios staff deem it necessary for an ambulance to be called, any incurred costs will be at the expense of the participant.

  • Authorised persons at TINY Studios may administer first aid, take a participant to a hospital, call for an ambulance or otherwise seek appropriate treatment, in the event of any illness, injury or near miss while participating in TINY Studios activities. If you do not want to give permission, please inform TINY Studios in writing.

 

Attendance Policy
 

Physical Theatre Studio
 

  • TINY Studios has the right to request a participant to leave the Physical Theatre Studio if they are consistently late or absent, where reasonable justification has not been provided to TINY Studios.

  • From 14 days after the commencement date, a minimum of 80% attendance is required, unless otherwise discussed. Failure to attend without reasonable cause may result in you being asked to leave the program.

  • You must reasonably attempt to advise TINY Studios ASAP if you are going to be late to a class, or if you are going to be absent. If this consistently does not occur, and TINY Studios is unable to work things out with you or contact you, your enrollment may be cancelled and as per the cancellation policy, and refunds will be issued as per the refund policy. 
     

Pop-up Workshops

 

  • Students must have arrived and be ready to go at the designated start time. Latecomers may not be allowed.

  • Due to the nature of some Pop-up Workshops, latecomers may not be accepted into the workspace once a workshop has commenced. As such, TINY Studios has the right to refuse a participant entry into the workspace if deemed inappropriate.

  • You must reasonably attempt to advise TINY Studios ASAP if you are going to be late to a Pop-up Workshop. If this does not occur, your participation may be refused.

 

Payment Terms (Fees and Charges)
 

Physical Theatre Studio

 

  • Fees are charged on a per year basis. All transactions are processed in Australian dollars.

  • Within 14 days of being offered a spot in the program, a non-refundable deposit of 20% of the RRP course cost must be paid to secure your enrolment, along with agreement to these terms. You will not have a spot in the course until the full deposit and your acceptance of the Terms of Service are received. Early Bird Discounts and other promotional discounts do not apply to the deposit amount.

  • Alternative payment arrangements may be available. All alternative payment arrangements must be requested and agreed upon in writing and before the commencement of the program.

  • All alternative payment arrangements are subject to the terms and conditions outlined between TINY Studios and the participant. Failure to meet those terms and conditions may lead to cancellation of enrolment as per the cancellation policy.

  • The full course balance (deposit plus remainder of course fees, less promotional discounts) must be paid prior to the commencement of the program, unless prior alternative payment arrangements have been made between the participant and TINY Studios.

 

Pop-up Workshops

 

  • Fees are charged on a per workshop basis. All transactions are processed in Australian dollars.

  • The full workshop fee must be paid upfront at time of enrollment.

  • Until the full workshop fee and your acceptance of the Terms of Service are received, you are not guaranteed a spot in the workshop.

  • You will receive these Terms of Service either via email or during the online enrollment process.

  • Alternative payment arrangements may be available. All alternative payment arrangements must be requested and agreed upon in writing. Email counts as writing.

  • All alternative payment arrangements are subject to the terms and conditions outlined between TINY Studios and the participant. Failure to meet those terms and conditions may lead to cancellation of enrolment as per the cancellation policy.

 

Discounts

 

  • Where a deposit has been made to secure your spot in a TINY Studios program, discounts will only apply to the remainder of the course fees and are not applicable to the deposit amount.
    EG
    Course Total - $200.
    Deposit (20%) - $40.  
    Remaining fees - $160
    Discounts will be applied to the $160.

  • Pay up-front discount:

    • Pay the full fee amount for the Physical Theatre Studio and receive a 10% discount on the total fee, less any deposit.

    • You will not be eligible for this discount if you have made any alternative payment arrangements with TINY Studios.

    • The discount will be automatically applied by TINY Studios and outlined in your payment instructions email.

    • This discount is not applicable to Pop up Workshops.

  • Early bird discount:

    • Secure your enrollment by the advertised Early Bird Date/s to receive a 5% discount on program fees (excluding any deposits, where applicable).

    • The discount will be automatically applied by TINY Studios and outlined in your payment instruction email.

    • This discount is applicable to both the Physical Theatre Studios and any Pop-Up Workshops.

  • You may combine both discounts for a total discount of 15% (excluding the non-refundable deposit amounts, where applicable).

 

Cancellations and Terminations of Enrolment
 

  • All activities at TINY Studios are subject to minimum enrollment numbers and cannot proceed if the minimum number of enrolled, financial students is not met.

  • TINY Studios reserves the right to cancel the Physical Theatre Studio or a Pop-up Workshop, partially or entirely, due to insufficient financial participants or for other unforeseen circumstances.

  • In the event of TINY Studios needing to cancel a program or workshop, partially or entirely, TINY Studios will reasonably attempt to contact enrolled participants min 48 hours before the scheduled class or program is due to start.

  • In the event of TINY Studios required to cancel the Physical Theatre Studio or a Pop-up Workshop, partially or entirely, first they will reasonably try to reschedule with students. Then if unable to, may provide a financial or equitable option as recompense, in consultation with the student and in line with the Refund Policy outlined in this document.

  • TINY Studios has the right to request a participant to leave part of the Physical Theatre Studio or a Pop-up Workshop, or leave in its entirety, if they are found to be in breach of any clause/s outlined in these Terms of Service, and for any reason deemed appropriate at the discretion of TINY Studios.

  • For the Physical Theatre Studio, students will have 14 days to decide if this is the right fit for them. If they deem it not a good fit, they must place a written request to unenroll within these 14 days.

  • Cancellation requests received more than 5 working days prior to the commencement of the Physical Theatre Studio or a Pop-Up Workshop will incur a 20% cancellation fee.

  • All cancellation requests/unenrollment requests must be made in writing to TINY Studios.

 

Refund Policy
 

  • In the event TINY Studios needs to cancel the Physical Theatre Studio or a Pop-Up Workshop due to insufficient financial participants, TINY Studios will refund any deposits made (where applicable), as well as any other payments made towards the enrollment.

  • Should TINY Studios need to cancel the Physical Theatre Studio or a Pop-Up Workshop for any other reason, and cannot find a satisfactory alternative, a partial or full refund may be issued. TINY Studios accepts no liability for any other costs.

  • If you miss any part of the Physical Theatre Studio or a Pop-Up Workshop, a credit or refund is not applicable, nor is attending a replacement class.

  • Pop-up workshops are non-refundable if cancelled within 5 days of the commencement date.

  • Exceptions to the cancellation terms may be made at the discretion of TINY Studios management.

  • Ultimately, refunds are at the discretion of TINY Studios, and they have the final say regarding a refund request outcome.


Physical Theatre Studio

 

  • The 20% course deposit is non-refundable.

  • Cancellation/unenrollment requests made after 14 days from the commencement date will not receive any refunds.
     

Safety, Wellbeing and Inclusion Practices
 

  • Due to the nature of TINY Studios activities, it may be necessary for a voice, movement or other tutor to support your training with physical contact. Likewise, it may be appropriate for other students to come into physical contact with you when engaging in an exercise.

  • Students may opt out of some activities EG physical contact. TINY Studios encourages open communication around any element of the program that may cause concern for students and is available for confidential conversations.

  • TINY Studios takes seriously its commitment to providing a safe and inclusive learning environment, free from bullying, discrimination or harassment. We do not tolerate or condone actions of anyone – students, staff or visitors – that constitutes bullying and harassment towards anyone engaging with TINY Studios and its associated activities.

  • Bullying refers to behaviour where any person– student, staff or visitor – directly or indirectly, repeatedly behaves (words or actions) unreasonably towards a person or group of people to cause distress and that behaviour creates a risk to health and safety or hinders that person’s ability to attend a TINY Studios venue or participate in TINY Studios activities.

  • Harassment refers to behaviour when any person – student, staff or visitor – causes another person to feel belittled, intimidated offended, apprehensive or singled out.

  • If a student, staff person or visitor is accused of bullying or harassment, TINY Studios management will investigate the situation and consult with all parties. In the event that the investigation is ongoing but unresolved, it may be deemed necessary to temporarily restrict attendance to a class or TINY Studios venue as a precautionary measure.

  • Any person who is found to have either committed or condoned discrimination, bullying or harassment may be removed permanently or restricted from attending TINY Studios activities or venues.

 

Notification of Changes
 

TINY Studios reserves the right to make amendments to its Physical Theatre Studio or Pop-Up Workshops without notice.

We acknowledge and pay respect to all the First Nations people and Traditional Custodians on whose lands we work on.

We recognise the importance of their cultures, their wisdom and their creativity.
